Terms & Conditions
In these terms:
‘Us’ or ‘we’ refers to Chubby Bunny Co
‘You’, ‘customer’ or ‘client’ refers to the purchaser of goods from Chubby Bunny Co.
Payment Terms
If you are placing an order for an event that is less than 2 weeks away, we ask for full payment in order to secure the booking.
If you are placing an order for an event that is more than 2 weeks away, we ask for a "save the date" deposit of £30, then the remaining balance is due 7 days before the day of event. If the remaining balance of the invoice is not paid, this will result in the order being terminated and the deposit non-refundable.
We do not hold any dates in our diary until payment (as detailed above) has been received.
Upon making payment, you are accepting our terms & conditions.
Cancellation must be received in writing. The following terms apply:
Notice of cancellation (before the event)
4 months or more Full Refund
Between 2 - 4 months 60% Refund
Less than 2 months 30% Refund
Less than 4 weeks No refund.
Covid 19
If your event has to be cancelled due to a change in Government restrictions for Covid 19, we will charge a small fee (10% of the value of your balloon order) towards our costs incurred (eg. materials purchased, administration and potential loss of business due to booking commitment). We will arrange to refund you the remainder of the deposit or balance paid.
Products and Pricing
We only supply goods to adults (over 18).
Many of the designs are bespoke and therefore there may be a slight variation between the image shown and the product received. Our aim is to ensure continuity and that you are delighted with your product.
Prices are determined at the time of order and, prior to payment of the deposit, are subject to change without notice.
Set-up/Installation
We are dedicated to ensuring that we are on time for all of our bookings but we cannot be held responsible for delays due to unforeseen circumstances such as traffic holdups or extreme weather conditions. We will contact you on the telephone number provided if unforeseen problems occur.
In the unlikely event that the booking has to be cancelled by us then a full refund will be paid.
We reserve the right to alter decorations where necessary if the original design is unsuitable on the day.
If the event is outdoors, we will not be held responsible for balloons being damaged as a result of weather conditions.
We request that you arrange access to the venue for the time arranged. We cannot be held responsible for any delays incurred due to problems accessing the venue.
Balloons can pop. Whilst we use the highest quality balloons and take every precaution necessary to ensure that they last throughout your event, once the balloons leave our door, or we have left the venue, they are out of our control. We will not be held liable for any damage caused to or by the balloons once decoration/delivery is complete. Hire items
When hiring out items (including frames used for balloon arches and décor) additional terms apply. Please see our hire agreement for more information.
Being responsible with balloons
Care must be exercised to ensure that all decoration items are safely and securely disposed of - please refer to our page on Balloons and the Environment
On no account should helium balloons be inhaled or released into the atmosphere.
Please note that the goods supplied are not toys and are not suitable for children to use unsupervised. Ribbons tied to balloons and uninflated balloons can cause choking. It is your responsibility to ensure that all children are appropriately supervised when handling these items. Please read our balloon safety warnings.
Hire Agreement
Definitions
In these terms and conditions of hire, the following meanings shall apply:
“we, us, our” refers to Chubby Bunny Co.
“you, your” refers to the named person on the booking.
“your hire" means all arrangements and items sourced and organised for you by us.
1. Property Ownership & Responsibility
01.1 All equipment and hire items are the property of Chubby Bunny Co and
remain so at all times throughout your hire.
01.2 By accepting these terms and conditions, you agree that you are solely
responsible for the hire items at all times throughout your hire, from acceptance or
pick up of the items until you return the items or they are collected by us.
2. Security Deposit
02.1 A security deposit is due upon booking. The security deposit will be returned in
full once the items have been collected (or returned) and checked for any damage or
loss. The security deposit will not be refunded in the following circumstances:
- The item(s) is missing
- The item(s) is damaged
- The item(s) has not been returned to us within the specified hire period
3. Standard Hire Period
03.1 Unless specifically arranged at the time of booking, all standard hires are based on a total of 48 hours.
4. Extended Hire
04.1 Extended hire may be possible on request.
5. Collection of item(s)
05.1 Collection will take place at a pre-arranged time and date.
05.2 Items must be available for collection at the delivery address, unless otherwise agreed. Items must not be left in an unsecured or unattended location.
6. Customer Returns
06.1 If you have chosen to return the item(s) yourself, you must ensure the item(s) are dropped off to 142 Orchard Road, Birmingham, B24 9JF.
06.2 The items must be accepted back into our possession and not left unattended outside or with neighbours.
7. Safety
07.1 We are not responsible for any injury or damage to people, property or objects arising from the use of any equipment under hire. We shall not be liable for any direct, indirect or consequential loss, damage or additional costs that may arise as a result of the use of our hire items.
